Welcome to Tryonr. These Terms of Service ("Terms") govern your access to and use of our AI-powered virtual try-on and product photography website and service (the "Service"). By accessing or using Tryonr, you agree to be bound by these Terms and our Privacy Policy.

Please read these Terms carefully before using our Service. If you disagree with any part of these Terms, you may not access the Service.

  • "Service": Refers to the Tryonr website, AI-powered virtual try-on tools, multi-angle generation, feature annotation, and related services
  • "AI-Generated Content": Virtual try-on photos, multi-angle views, feature annotations, and other images produced by our AI system
  • "User Content": Any garment photos, model photos, or other materials you input into the Service
  • "We," "Us," "Our": Refers to Tryonr
  • "You," "Your": Refers to you as a user of the Service

Account Registration and Security

Creating an Account

To use certain features of Tryonr, you must create an account by:

  • Providing accurate and complete information
  • Maintaining the security of your password
  • Accepting responsibility for all activities under your account

Social Login

You may also access the Service through:

  • Google OAuth: Login using your Google account
  • GitHub OAuth: Login using your GitHub account

When using social login, you authorize us to access basic profile information (name, email, profile picture) from the respective provider.

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials

Use of the Service

Tryonr is provided "as is" and "as available." We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Technical issues
  • Circumstances beyond our control

AI-Generated Content

Our Service uses artificial intelligence to generate virtual try-on photos and product images. You understand and acknowledge that:

  • AI-generated content is produced automatically based on your inputs
  • We do not guarantee the exact accuracy of generated images
  • Generated content should be reviewed before commercial use
  • You are responsible for ensuring generated content aligns with your brand standards

Free and Premium Features

Tryonr offers both free and premium features:

  • Free Features: Basic virtual try-on generation with usage limits and free credits
  • Premium Features: Enhanced generation capabilities, additional credits, and advanced tools

Usage limits may apply to free accounts and are subject to change with reasonable notice.

Credit System

  • Tryonr uses a credit-based system for AI generations
  • Different features consume different amounts of credits
  • Credits can be purchased through our payment system
  • Unused credits do not expire unless your account is terminated

User Content and Generated Images

Your Responsibilities for User Content

You represent and warrant that:

  • You own or have the right to use all garment and model photos you input into the Service
  • Your User Content does not infringe on any third-party rights
  • You will not input confidential, proprietary, or sensitive information
  • You will not use the Service to generate content that violates laws or regulations

Rights to User Content

You retain all rights to your User Content. By using our Service, you grant us a limited license to:

  • Process your User Content to generate virtual try-on images
  • Store your User Content to provide the Service
  • Improve our AI models (with appropriate privacy protections)

Rights to AI-Generated Images

Regarding AI-generated images:

  • Ownership: You have the right to use, modify, and commercialize generated images for your products
  • No Warranty: We do not warrant that images are unique or free from copyright claims
  • Due Diligence: You are responsible for ensuring generated images are suitable for your intended use
  • Modification: You may modify generated images to suit your needs

Content Moderation

We reserve the right to refuse or remove User Content or generated images that:

  • Violate these Terms or our policies
  • Are unlawful, offensive, or inappropriate
  • Infringe on intellectual property rights
  • Pose security or privacy risks

Prohibited Uses

You may not use Tryonr to:

  • Generate content that promotes illegal activities
  • Create images for counterfeit products or services
  • Infringe on copyright, trademark, or other intellectual property rights
  • Generate content that is defamatory, harassing, or harmful

Misuse of AI

  • Attempt to reverse engineer or extract training data
  • Use automated tools to overuse or abuse the Service
  • Generate content designed to deceive consumers
  • Use the Service for any malicious purpose

Technical Abuse

  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Introduce viruses, malware, or malicious code
  • Overload our servers or infrastructure

Brand and Trademark Issues

  • Generate images that misrepresent existing brands
  • Create content that infringes on trademark rights
  • Use the Service to commit intellectual property violations

Commercial Restrictions

  • Resell access to the Service without authorization
  • Use free features for large-scale commercial operations beyond intended limits
  • Use the Service to compete directly with our business

Intellectual Property

Termination

You may stop using the Service at any time. To delete your account, contact us at support@tryonr.com.

Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice, for:

  • Fraudulent or abusive behavior
  • Extended periods of inactivity
  • At our sole discretion for any other reason

Effect of Termination

Upon termination:

  • Provisions that should survive termination will remain in effect

  • AI-generated images may be retained for a limited time for operational purposes

TRYONR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Implied warranties of fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free operation

AI-Generated Content Disclaimers

We specifically disclaim any warranties regarding AI-generated images:

  • We do not guarantee accuracy or realism of generated images
  • We are not responsible for how generated images are used
  • You use generated content at your own risk
  • Professional review is recommended for commercial use

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • This limitation applies regardless of the theory of liability

Exception

The above disclaimers and limitations do not apply to the extent prohibited by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Tryonr and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of others

Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

For any disputes arising from these Terms or your use of the Service:

  2. If direct communication doesn't resolve the issue, disputes will be resolved through binding arbitration
  3. Arbitration will be conducted in English under internationally recognized arbitration rules

Class Action Waiver

You agree that any dispute resolution will be conducted on an individual basis only. Class actions, class arbitrations, and representative actions are prohibited.

Changes to Terms

We may update these Terms from time to time to reflect:

  • Legal or regulatory requirements
  • Business policy updates

When we make changes:

  • We will update the "effective date" at the top of these Terms
